This appeal arises out of an action by Penelko, Inc., the owner of a theater, against the defendants Price Rentals, Inc. (Price), John Price Associates, Inc., and C. F. Malstrom and Alvin Malstrom for an injunction and for damages resulting from an alleged breach of lease and/or tortuous interference with Penelkos theater business. John Price Associates, Inc., and C. F. and Alvin E. Malstrom were found as a matter of law to have no liability to plaintiff for any acts or conduct of Price in connection with plaintiffs lease and the complaint was dismissed as to them. After an eight day trial the jury returned a $65,000 verdict in favor of Penelko against Price. The court entered judgment upon the verdict but refused to grant Penelkos request for an injunction or for attorneys fees. Price appeals seeking reversal of the $65,000 judgment and Penelko cross-appeals, seeking reversal of the trial courts orders denying injunctive relief and attorneys fees.
